Administrative Procedure Act n. the Federal Act which established the rules and regulations for applications, claims, hearings and appeals involving governmental agencies. Many states have an Administrative Procedure Act that requires a
government agency (including a taxing authority) to promulgate formal
regulations to articulate a rule of general applicability. To answer this question, the court had to determine whether
the Administrative Procedure Act applied and--consistent with prior
decisions--concluded it did not. While
the Administrative Procedure Act allows parties to be "accompanied,
represented, and advised by counsel," it does not state or suggest
that parties are entitled to discuss their on-going testimony with
counsel while on breaks at an administrative hearing. |
