attorney's work product

attorney's work product n. written materials, charts, notes of conversations and investigations, and other materials directed toward preparation of a case or other legal representation. Their importance is that they cannot be required to be introduced in court or otherwise revealed to the other side. Sometimes there is a question as to whether documents were prepared by the attorney and/or the client for their use in the case preparation or are documents which are independent and legitimate evidence. 9) Public Records Law and the Attorney-Client and Work Product Privileges Early in the history of Florida's Public Records Act, the Florida Supreme Court declined to recognize any exemption for a government attorney's work product or attorney-client privileged documents.
Under this privilege (codified in Federal Rule of Civil Procedure 26(b)(3)), a party seeking an attorney's work product covered by the privilege is entitled to it only on a showing of a substantial need for it.
