Question

Country: United States of America
State: Connecticut

I found a buyer for a car I am selling. They agreed to buy the car for $3000 and gave me a down payment of $2000. We wrote up a contract stating this. We also added that if they changed their mind, I would refund the down payment minus $300. After 4 days they changed their minds and stopped payment on the check. They would not honor the $300 stipulation in the contract. In addition, I turned away 2 potential buyers because of this deal. Will I win in small claims court? I have a contract which both parties signed.

Answer

Yes you will win in small claims--the agreement is binding and valid..
