Walton Jail warders Steve Baines and Paul Leigh have been warned they are in breach of prison rules because of the pounds 400 staff whip round.
It emerged last night that officers may not be able to prosecute the inmates as they did not leave the grounds of the jail - meaning the protest was a breach of prison security, rather than a prosecutable offence.
Rumley had been jailed for 32 months in April last year for burglary and breach of prison licence and he still had 472 days outstanding from that sentence.
