CASSATION, French law. A decision which emanates from the sovereign
authority, and by which a sentence or judgment in the last resort is
annulled., Merl. Rep. h.t. This jurisdiction is now given to the Cour de
Cassation.

In July 1906, France's Cour de Cassation (Supreme Court) overturned the treason conviction of Captain Alfred Dreyfus, a French Jewish army officer who had spent five years on Devil's Island for high treason and an additional seven years trying to clear his name. Last July, the Cour de Cassation, the French equivalent of the Supreme Court, upheld a 1991 lower court ruling that awarded Nicholas damages. In rejecting his claims, the Court cited principles put forward by the Court of Cassation in the Gourlain family ruling on November 20, 2003. |
