State: Michigan

I have lived with my partner for 3 years the I receive money from sis they consider us married and took part of my benefit not all just part we lived in Michigan I was wondering if their law considers us common law married can I use his last name? she said they do consider us married under Michigan law....so if we are common law married then can I still get married to him? Legally? And if not can I use his last name? I really need to know. And we recently moved to Maine where we moved to Maine are we still considered married?
