What are the criteria for disqualification of a presiding judge in a Criminal case in which he or she is accused of bias by the accused Defense. Are there any case law or other persuasive authorities from Nigeria, Canada, US, India or UK? Please assist urgently because a judge had refused to recluse himself in a very important case which is regarded as politically motivated.

Answer

Your lawyer can move for the judge to recluse himself based on any conflict of interest; if he does not you may appeal the decision.
