Ask a Lawyer QuestionCountry: United States of AmericaState: Florida I am a 13 year employee with a near perfect record and was involved in a accident at work which could require a possible drug test. The incident occurred on 12-31-05 and I was not asked to take a test that day. 1-1-06 was a paid holiday. The following day, 1-2-06, I was told that I would have to take a drug test and did so voluntarily. After talking to several employees and managers, no one has ever heard of anyone having to take a drug test other than immediatly after an incident. I was tested 2 days after the incedent occurred and after thinking about it I feel as if it was unjustified especially considering it followed New Years Day. Do I have legal recourse if it is determined that no one else in the company has ever been tested other than immediatly after an incident? AnswerNot really--it can be requested at any reasonable time thereafter...How to thank TFD for its existence?
