Question

Country: United States of America State: Indiana I have a brother, who is an ex-convict...has been released from the Department of Corrections for almost 5 years now. He has served his time and is trying to get his life back in order. With that said, this past summer he held 3 jobs. Here is my concern or question...He held a job at the Marriot of South Bend IN. for a couple of months, the victim of his incarceration, her husband worked as a security guard at the Marriot and recognized my brother and told a manager of his past. He was fired on the spot for submitting a false employment application. We don't have a problem with that, what I have a problem with is the fact that on that job application was listed one of his 2 other jobs. The next day the victim called that restaurant and told the manager about my brothers past, he also fired my brother just from that call. My questions are... 1. Was my brothers privacy violated by the Marriot because human resources failed to keep the victims husband from seeing his application for employment. 2. Was the firing at the restaurant unlawful termination?

Answer

Unfortunately that normally does not need to be kept confidential. we do not see a violation of law here.
