Ask a Lawyer QuestionCountry: United States of AmericaState: Georgia I have an 04 Chevy Malibu. It's in my ex-husbands name only. He helped me get it. I make the pmts and pay for the car insurance. We have a written agreement between us that after the car is paid off he will transfer the title to me. Which I'm sure he will. However, I'm afraid if something happened to him before that time I would lose the car. I understand that because its in his name it would go to his estate. I know he doesn't have a will. If our kids get his things I'm ok but if he were to remarry I'd be in trouble. What kind of legal document do we need to make sure I won't lose the car under the above possible circumstances? AnswerHe should put title in your name now and take a lien on the car---so if you don't pay he can take itHow to thank TFD for its existence?
