my son was in an accident on 4/22/2003, he rear-ended a woman in commuter traffic that pulled in front of him and slammed on her brakes she drove her car off. On 4/21/2004 she filed a lawsuit against my son and husband, to date we have never received a subpoena to go to court, nor has our insurance company. How long do we have to worry about if we are going to have to go to court? is there a limitation on this or is it something they can hold over our heads forever?

They may have dropped the case--but your insurer should be informing you--ask them to check the status.
