Question

Country: United States of America
State: Michigan

This past Tuesday a man from the Newaygo County Sheriff's department came and took my 1999 Chevy Van as ordered by the court. This was done because of a balance owed of $2,800.00 to Providian credit card co. On December 8th my car will be sold at auction. Can this be done? Can they take a persons only transportation away for an unsecured credit card debt? (The car isn't running right now it has a cracked head and it has nearly 200,000 miles on it) And if the van doesn't sell for enough money is it possible for them to come now and take my household furnishings or maybe my home itself? Please help me, we (my husband, myself and our 11 yr.old daughter)live on my husbands social security disability and cant afford to hire representation. I don't know what to do. I think I will quit deed my house to my 11 year old daughter. That should keep my home safe shouldn't it?

Answer

Normally your car is exempt--ask them to explain; you could possibly sue...
