State: Missouri

I wanted to try eBay and was looking at an item. I clicked on "buy now" on an item. I did not for whatever reason realize that I would actually be buying that item. I thought it was to bid on that item. I contacted the seller and he is demanding payment or a lawsuit over this issue. Does he have a legal course of action? He said he cannot recover his listing fees and whatnot. I contacted eBay and they say he can receive credit. I am just curious if he has a legal case against me?

He normally will not prevail if you told him right away it was a mistake--
