Problems with eBay transaction

Ask a Lawyer

Question

Country: United States of America
State: New Mexico

I had trouble with a transaction on eBay. The buyer left negative feedback on my account that I consider to be libel. His money was refunded and I have records to prove it. Yet he calls me a liar and thief! The "thief" part is what concerns me. Having that in my feedback rating appears to be adversely affecting my sales, and it is simply not true, and I can prove it. Should I speak with a lawyer about getting a "cease and desist" letter sent to him?

Answer

You could sue him for that yes--"thief" is defamatory--
