Sentenced to jail for driving without a license/revoked probation

Country: United States of America State: Colorado My husband was sentenced to a halfway house for a revoked probation. Unfortunately even though his sentence was not a DOC sentence he was accepted by a DOC halfway house. And when he had about four months left he got caught driving with out a license. And was sentenced to nine months jail time, with the possibility of work release so the halfway house took him out of their program, he is currently sitting in Arapahoe county jail waiting for a court date to see what the judge will do now because of the halfway house revoking his stay there. I was told that now even though this is not a DOC case that the only option he will have to finish this sentence is prison! Is this true? It doesn’t seem right to me that just because the halfway house that accepted him was a DOC halfway house he can have his good time taken away and go to prison for the remainder of his time. When his case was never a DOC case? It seems really harsh to me. Do we have any options other than prison?

Answer

There is still the option of other non-prison sentences; but the court is going to need some kind of reasoning for why this all happened. And Assurance it will not happen again.
