| The English Governor of Massachusetts, Sir William Phips, established the Court of Oyer (to hear) and Terminer (to decide) to determine the fates of these individuals. The compilation of rapes, attempted rapes, murder, and attempted murder utilized in this research is derived from an examination of all these specific crimes found in the Essex County Clerk's office indictment records for the Court of General Sessions, Special Sessions, and Oyer and Terminer from 1799 to 1860. This argument seemed plausible enough until Michael Hicks examined the records of the oyer and terminer commission appointed to try the rebels. |
