Ask a Lawyer QuestionCountry: United States of AmericaState: Florida I had a court appearance in which I was 2 hours late for.The original charge was possession of cocaine. I have a private attorney who had called the judges office for a continuance early that morning but I was to appear.I came in 2 hours late and the judge had me put into custody and sent to jail.I had no attorney present and yet I was put under oath, asked questioned concerning the failure to appear. The prosecutor made a very strong case against me and i was taken in to custody without counsel. My question is were my civil rights violated? Can the original case be thrown out? Can I win in a law suit for violation of my rights? Can I have the judge and prosecutor removed from this case? What do you recommend? AnswerYou could have refused to answer until counsel was present--it may be more difficult now--How to thank TFD for its existence?
