transfer in contemplation of death n. giving property under the belief by the giver that he/she is about to die or has a terminal illness. However, health recovery may result in cancellation of the gift. This is also called a "gift causa mortis."

In Milliken, the Court held that the increase in estate tax rates did not constitute a deprivation of property without due process of law if the decedent had reasonable notice from the existing tax statute that an intervivos transfer in contemplation of death would be taxed as part of his estate.
