Caught stealing, work didn't press charges/police did

Question
Country: United States of AmericaState: Kansas
My roommate was caught stealing property from his work. He was told by the store (his employer) that they were not going to press charges and they had him sign a $500 promissory note and returned the stolen merchandise to him, as they said it was considered damaged and he was purchasing them with the note. However, the local cops were present and told him that he was going to court over it. Is this possible, as the store said they are not going to prosecute or press charges due to the $ amount and the expense they would incur? I would be more than willing to explain further if need be.
Answer
The state can still choose to prosecute on their own. These questions and answers are provided by WORLDLawDirect.com. ©2000 - 2007 by WORLDLawDirect.com, Inc.
