as of rightin the law of prescription, use as of right is use nec vi (‘without force’), nec clam (‘without secrecy’), nec precario (‘without request’). To be able to establish an easement or profit by prescription at common law or under the doctrine of lost modern grant (or, indeed, under the Prescription Act 1832 except insofar as it otherwise provides) the claimant must be able to show user as of right.
