homologation

approval or sanction. In particular, a form of personal bar (estoppel) in Scots law. It focuses on the acts of the party seeking to escape an obligation as approbatory of the obligation. It is now of much less practical significance because a statutory equivalent has been introduced by the Requirement ofWriting (Scotland) Act 1995.

HOMOLOGATION, civil law. Approbation, confirmation by a court of justice, a judgment which orders the execution of some act; as, the approbation of an award, and ordering execution on the same. Merl.
