The Court of Appeals held that because the state was not required to show that the department store suffered a net loss resulting from appellant's actions, as it was possible to have a conviction for theft-by-swindle even if there is no net loss to the victim, and evidence that appellant returned 36 misticketed items and was credited $5,501.36 in exchange for those items supported the finding that the damages suffered were over $1,000.
