traditionibus non nudis pactis dominium transferuntur‘delivery, not a simple agreement, transfers ownership’. This is the basic rule of the civilian systems, but it no longer applies in Scotland to goods where the Sale of Goods Act 1893 allowed property to pass by agreement. In relation to non- ‘goods’, mainly land, the common law rule applies.
